On the threshold of a disaster

Le Pulec - A Stinky Pool
Wrecks in the shipping lanes that pass Jersey are becoming far too common, and it is only a matter of time before an environmental disaster hits here, so the folllowing from Lloyds list is not very comforting:

MSC Napoli widens claims concerns

January 25 2007 Lloyds List

COASTAL hazards unleashed by the MSC Napoli have highlighted alarming insurance exposures that governments and underwriters must tackle, a top US claims expert has warned, writes James Brewer.

David Siesko, who spent 15 years at carrier Zurich Financial Services before launching his own firm, Siesko Partners, said the marine liability conventions sprang from concern many years ago over the impact of tanker spills, but questions must be raised whether the liability regime fully addresses the issue of hazardous cargoes such as chemicals and batteries.

He said governments should heed the experiences of the US with its 1976 Resource Conservation and Recovery Act, which obligated businesses which handle, transport or store hazardous materials to take out third party liability insurance. The insurance industry had responded in a robust way to minimise risk.
The federal law aimed to protect the public from harm caused by waste disposal and clean up spilled or badly stored wastes.

Mr Siesko, whose professional mission is to simplify claims processes and avert disputes, said that while the MSC Napoli involved a “traditional loss” in insurance terms it created additional exposures that might never have been considered when treaties and conventions were drafted.

While the best way of dealing with oil pollution was often to allow it to dissipate, other hazardous materials had to be recovered. Scattering cargo on the shore brought other insurance covers into play, such as personal injury.
He stressed that the insurance industry had to focus more on risk management. Ships such as MSC Napoli could never sail without the industry providing insurance.

The footpath with wonderful views has been closed since a stray fire work set fire to the headland. The path is fine apart from a couple of steps that need to be replaced.
